Terms of use

The general terms and conditions: what you may use tomorrow.garden for, how to order a garden plan, and what your rights are as a buyer.

The provider

tomorrow.garden is provided by Pánácz Digital Kft. (registered seat and postal address: 9672 Gérce, Kossuth utca 2., Hungary; company registration number: 18-09-116022, registered by the Szombathelyi Törvényszék Cégbírósága; tax number: 32579374-2-18; e-mail: [email protected]). The details of the hosting provider are in the imprint.

What do these terms cover?

These terms cover the use of tomorrow.garden and the garden plan ordered here. You accept them by using the site and, when ordering, by ticking the checkbox.

An order creates a distance contract between us, concluded by electronic means. It does not count as a contract made in writing and we do not file it separately: its content is given by these terms and the details of your order, which the confirmation e-mail and the invoice record. The contract is made in the language in which you read the site when ordering (Hungarian, English, German or Slovak). We have not subscribed to any code of conduct.

The free services

The plant finder, the plant pages, the plant lists, the comparisons, the My garden list and the watermarked preview of the garden plan are free to use, without registration. We may change, limit or end them at any time.

The garden plan

The garden plan is digital content that artificial intelligence puts together from the details you give (a photo or a drawing, the conditions of the place, style, wishes), following horticultural rules. One order covers one part of the garden: the area you gave in the planner.

  • What it contains: three versions in three styles; for each, a garden picture of the summer of years 1, 3 and 5 after planting; a plant list with quantities and indicative shop prices; a fact sheet for every plant; a planting scheme drawn to scale; and the plan can be printed and saved as a PDF.
  • The garden picture is an illustration: it shows the mood, and the real garden may differ from it. The exact data is in the plant list and the planting scheme.
  • The plan is not based on a site survey and does not replace the on-site advice of a gardener, a garden designer or a nursery. It does not design paving, structures, irrigation or utilities.
  • The shop prices and availability of plants are indicative, and the shops are independent of us. We do not sell or deliver plants.
  • What you need: an internet connection and an up-to-date browser. You do not need to install anything.

Price and payment

The garden plan costs €22. This is a one-off fee that includes value added tax; there is no subscription and no further cost. We show the price in the currency of the country, and you always see the total to pay before you order. We may change the price, but an order already placed keeps the price it was placed at.

If you have a coupon code, you can enter it when ordering; the discount is shown before payment. One coupon can be used per order, and it cannot be exchanged for cash.

You can pay by bank card, on the secure payment page of Stripe. We never see your card details. We issue an electronic invoice for the purchase and send it by e-mail to the address you gave.

The steps of ordering

  • 1. In the garden planner you give the details of your garden, and the free, watermarked preview of the plan is made.
  • 2. On the page of the plan you give your e-mail address and, if you have one, the coupon code, then tick the declaration about immediate performance and the acceptance of these terms.
  • 3. You give the billing details and place the order with the payment button. The order comes with an obligation to pay.
  • 4. You pay the fee on the page of Stripe. The contract is concluded when we confirm the successful payment.
  • 5. We confirm the order by e-mail: we send the address of your plan and, in a separate message, the invoice.

Correcting mistakes, confirmation

Until you pay you can step back at any time and change the details of your garden, your e-mail address and the billing details. If you notice a mistake after paying (a mistyped billing address, for example), write to [email protected] and we will correct it.

If the confirmation e-mail does not arrive within 48 hours, check your spam folder and write to us. If we do not confirm your order within 48 hours, you are released from your offer and we refund the fee you paid.

Performance

The full plan opens at the address of the plan immediately after successful payment. The further style versions and the garden pictures are made after that, typically within a few minutes; the page refreshes by itself.

The plan can be opened at its address for five years from the purchase, after which we delete it. We recommend that you also save it as a PDF. Anyone who knows the address of the plan can open it, so pass it on only to those you want to show it to.

If the plan does not open or is not made for a technical reason, write to [email protected]: we will put it right, and if we cannot do so within a reasonable time, we refund the fee.

Right of withdrawal

As a consumer you may, as a rule, withdraw from a distance contract within 14 days without giving a reason (Section 20 of Hungarian Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses, which implements Directive 2011/83/EU).

The garden plan, however, is digital content not supplied on a tangible medium, and we begin to perform immediately after payment. You expressly ask for this when ordering, and at the same time acknowledge that you lose your right of withdrawal once performance has begun (Section 29(1)(m) of the Decree). We also record your declaration in the confirmation e-mail. After the plan has opened, withdrawal without a reason is therefore not possible.

If performance has not begun for any reason (the full plan did not open), you may withdraw within 14 days of the order with a clear statement sent to [email protected]. In that case we refund the fee within 14 days of receiving your withdrawal, by the same means of payment you used; the refund costs you nothing.

If something is wrong with the plan

If the garden picture spoils the house, the path or another existing feature, you can have it redrawn free of charge on the page of the plan; to prevent abuse, the number of redraws is limited. If that does not help, write to us and we will sort it out.

In the event of defective performance you have statutory rights under the Hungarian Civil Code (Act V of 2013) and Government Decree 373/2021 (VI. 30.) on digital content. Performance is defective if the plan does not match what is described in this document and on the site. First of all you can ask us to bring the plan into conformity free of charge (to correct it or make it again). If we do not undertake this, cannot do it within a reasonable time, or the defect is serious, you can ask for a proportionate price reduction, or end the contract and get the fee back. The contract cannot be ended over a minor defect.

Tell us about the defect without delay after you discover it; a defect reported within two months of discovery counts as reported without delay. The claim lapses two years after performance. A defect recognised within one year of performance is presumed to have existed at the time of performance; after that, you have to prove it.

It is not a defect if the plan is not to your taste, if the garden picture differs from reality in its details (it is an illustration), or if a plant is out of stock or sold at a different price in the shops. We give no commercial guarantee on the garden plan; product liability warranty applies only to movable goods, which the garden plan is not.

The photo you upload and your requests

Upload only a photo that you have the right to use and that shows no recognisable person, number plate or other detail that can be linked to a person. By uploading you allow us to use the photo and the details you give to make the plan and the garden picture, and to pass them to our artificial intelligence provider for that purpose. We use them for nothing else, and the photo remains yours.

Do not upload or type in anything unlawful, offensive or unrelated to the garden plan. We may delete such content and the plan it belongs to.

What may you use the plan and the content of the site for?

You may use the plan you bought for your own garden without a time limit: you can print it, save it, and show it to your gardener, the nursery or your family. You may not resell it or offer it as your own service.

The texts, figures and illustrations of the site, the compilation of the database, and the tomorrow.garden name and logo belong to the provider. You may freely use the content of the site for private purposes; commercial or bulk reuse needs our prior written consent.

The data is for guidance only

  • We compile the plant data carefully from several sources, but we do not know the conditions of your garden: the recommendation and the plan do not replace the on-site advice of a gardener or a nursery.
  • Toxicity data is for guidance only. If your pet or child has eaten a plant, contact a vet or a doctor.
  • Prices are rounded, indicative prices collected from the ranges of shops. The shops are independent of us, and their prices and stock may change; always check the conditions of purchase on the site of the shop.

What do we ask of you?

Use the site as intended: do not overload it with automated requests, do not try to get round its protection or its daily limits, and do not use it for unlawful purposes. Only those aged 18 or over may order a garden plan.

Liability

We provide the free services as they are at any given time. We are not liable for damage that arises because someone decides on the basis of the indicative data read here without asking a professional, nor for the site being temporarily unavailable.

The garden plan is a suggestion. We cannot guarantee that the plants will take in your garden and develop as shown in the picture, because that also depends on planting, care, weather and soil. Carrying out the plan (buying the plants, planting, any permits, and keeping to the rules between neighbours) is your decision and your responsibility.

These limitations do not affect our liability for breach of contract caused intentionally or harming human life, physical integrity or health, nor the rights that consumers have by law and that cannot be excluded.

Complaints and disputes

Send your complaint to [email protected] or by post to our registered seat. We answer it in writing and on its merits within 30 days; if we reject it, we give our reasons. We keep the complaint and the reply for three years.

If, as a consumer, you disagree with our reply, you can turn free of charge to the conciliation board of your place of residence or stay in Hungary, in whose procedure we cooperate; the contact details of the boards are at bekeltetes.hu. You can also turn to the consumer protection authority (the county government office of your place of residence, kormanyhivatalok.hu), and you can pursue your claim in court.

If you live in another member state of the European Union, the European Consumer Centre of your country of residence also helps to settle a cross-border complaint.

These terms are governed by Hungarian law. If you are a consumer living in another country, this does not deprive you of the rights given by the mandatory consumer protection rules of your country of residence.

Changes to the terms

We may change the terms if the service or the law changes. The changed text takes effect when it is published; an order already placed is governed by the terms in force when it was placed.

Effective from 16 October 2026.
